What is counterfeiting and piracy?
There is no universally recognised definition of counterfeiting and piracy. The definitions below orientate themselves towards those of the TRIPS Agreement as well as the EU Product Piracy Regulation. Certain schools of thought, however, express criticism concerning the open formulation of the definition of piracy in particular and therefore are demanding restrictions to it in terms of intent, targeted action, profuse copying and, where appropriate, commercial nature as well as profit motivation.Counterfeiting is the infringement of proprietary rights on patents, designs, trademarks, or geographical indications with the intent of imitating the original product.
Piracy is the unauthorized copying of original works and performances which are protected under copyright or related rights.
